The Fifty-second Amendment of the Constitution of India, officially known as The Constitution (Fifty-second Amendment) Act, 1985, provides for the disqualification of members of either House of Parliament or a State Legislature on the grounds of defection. The Amendment inserted a new Tenth Schedule to the Constitution which contains provisions for such disqualification. ==Constitutional changes==
Section 3 of the 52nd Amendment amended article 102 to provide that a person shall be disqualified for being a member of either House of Parliament if he is so disqualified under the new Tenth Schedule added in the Constitution. Section 2 made a consequential amendment in article 101. Section 5 amended article 191 to provide that a person shall be disqualified for being a member of the Legislative Assembly or the Legislative Council of a State if he is so disqualified under the new Tenth Schedule. Section 4 made a consequential amendment has been made in article 190. Section 6 inserted a new Tenth Schedule to the Constitution which contains provisions as to disqualification of a member of Parliament or a State Legislature on the ground of defection.〔 〕
